Jammu, Feb 16 (UNI) Jammu and Kashmir High Court, Jammu Wing, today quashed on technical grounds the detention of Peoples Democratic party's (PDP) zonal president under the Public Safety Act (PSA), who was allegedly working as an overground worker of Hizbul-Mujahdeen (HM).
According to the detention order, Abdul Rahim Shan, a resident of Salbala, district Gool, was working for the militant organisation.
Shan was also charged to be in constant touch with HM Divisional Commander Mustaq Ali and Mohd Ashraf and number of other militants of the outfit.
According to the order he was involved in number of other militant activities since December 2006. And on this ground, District Magistrate Ramban detained him under the PSA on July 27, 2007, which he later challenged on various grounds.
However, Justice J P Singh after hearing the case observed that the District Magistrate had issued the detention order on the basis of dossier and other documents which were supplied by the Superintendent of Police.
Meanwhile, the order issued by the Magistrate detaining the petitioner was found unwarranted and illegal and he was ordered to be set to liberty forthwith if not required in any other case.
