Centre sealing notification challenged in SC

New Delhi, Feb 5: The Delhi Pradesh Citizen Council today challenged in the Supreme Court the Central government's notification of permitting desealing of commercial premises sealed on the apex court orders.

The Council in its writ petition has prayed to the court to declare the impugned notification dated January 30 as ''unconstitutional, unjust and illegal''. The petitioner has contended that the notification has been issued for political consideration and is an attempt to overreach the orders of this court. According to the petitioner, the government exercising its powers under section 5 of the National Capital Territory of Delhi Laws (Special Provisions) Act, 2007 has been trying to protect the properties which are not even protected by the Act itself.

Therefore, under no circumstances the terms of notification can go beyond the provisions of the Act.

The petitioner has also pleaded that the impugned notification is a ''colourable exercise'' aimed at protecting violators of civic laws at the cost of law-abiding citizens of Delhi.

The petition, filed through Jasbir Singh Malik advocate, has also prayed for the stay of the operation of the aforesaid notification S.No. 213 (E) dated January 31, 2008 issued by Union Ministry of Urban Development till the final disposal of the writ petition.
