Panaji, Jan 27 (UNI) The Bombay High Court at Goa will take up the final hearing oN A PIL filed by advocate Aires Rodrigues tomorrow.
The PIL challenges the appointment of Mr Nilkant Harlankar and Mr Francisco Silveira as Parliamentary Secretaries and conferring of Cabinet status to EDC Chairman Agnelo Fernandes, Deputy Chairman of Goa Planning Board Dr Wilfred D'Souza and Commissioner of NRI Affairs Mr Eduardo Faleiro.
Advocate Rodrigues, in his petition, stated that the appointment of Parliamentary Secretaries and conferment of status of a Cabinet Minister to others was in violation of the 91st Amendment of the constitution, which was meant to restrict the size of the Cabinet, which would put a huge financial burden on the state exchequer.
Justice D B Bhosle and Justice N A Britto will hear the PIL tomorrow. Earlier on August 22, the arguments on the PIL were heard by the Gos. He by Justice R M S Khandeparkar and Justice R S Mohite and the matter was reserved for order.
However, on August 24, the court did not pass any order but adjourned the matter stating that it would not be appropriate to deal with the matter as a similar case relating to the validity of the appointment of Parliamentary Secretaries and conferment of status of a Cabinet Minister in Assam was pending before the Supreme Court.
Later, on September 11, the High Court of Justice R S Mohite and Justice N A Britto granted liberty to advocate Rodrigues to move a transfer petition before the Supreme Court so that his PIL could be heard along with the Assam petition.
However, disposing the transfer petition filed by advocate Rodrigues, seeking transfer of his PIL to the Supreme Court, Justice S H Kapadia and Justice B Sudershan Reddy on October 12 in their order observed that the ends of justice would be met if the matter was heard and decided by the Bombay High Court at Goa.
