Counsel of the Bihar government and Supreme Court advocate Surendra Singh pleaded in the court of Justice R K Dutta that the designated courts verdict was based on the orders of the Income Tax Appellate Tribunal. He also exhibited the order of the trial court and argued that the evidences furnished by the CBI, investigating into the matter, were ignored at the time of judgement.

The argument of the prosecution counsel will continue tomorrow. Senior Supreme court advocate Ram Jethmalani would argue as the defence counsel in the case.

On Deceber 18, 2006, the special CBI court of Patna had acquitted Lalu Prasad and Rabri Devi, leader of Opposition in Bihar Assembly, in the DA case with an observation that the evidences produced by the prosecution were not enough to sentence the VIP couple in this connection.

Later, the Bihar government filed the petition in Patna High Court challenging the acquittal of the Lalu-Rabri duo in the case on February 16 last year.
