Spice calls on DoT to immediately issue LoI, ready to pay entry fee

New Delhi, Dec 31 (UNI) Spice Telecom today called on the Department of Telecom (DoT) to immediately issue Letter of Intent (LoI) for the circles it has applied for, saying delay in processing LOIs beyond the deadline can not be a basis for equating it with any other applicant who may have applied for GSM spectrum after its application.

''Please note that any manipulation of issuance of initial GSM spectrum allocation prior to us through manipulation of any of the intermediate administrative processes would constitute an illegality and also cause irreparable damage and loss to our company,'' said Spice Telecom's letter to the DoT.

Earlier, Spice Telecom had written a similar letter on December 20, where in it had requested for the immediate issue of the LoI for the circles it had applied for.

The company said this would enable it to make payments of entry fees and provide guarantees so that the LoIs are accordingly converted into licences pursuant to which applications for initial spectrum associated with licenses can be lodged with WPC.

Spice said it had applied for the circles in the country way back in August last year and based on the United Access Service Licence (UASL) guidelines within 30 days of the submission of its application, they should have been issued LOIs, which have not been awarded to it till date.

''Keeping in mind the above policy guidelines, we had organised funds in anticipation of LOI issuance within the prescribed time lines,'' the telecom firm said.

The DoT had initiated a complete chain of administrative processes like issuance of LoI, receipt of payments and guarantees within the stipulated period and culminates into application for spectrum.

''Delay in processing our LOIs beyond prescribed time lines cannot be a basis for equating us with any applicant who may have applied for GSM initial Spectrum after our date of application,'' it said.

Spice in its letter informed that it was ready to make payments of entry fees as also execute FBGs and PBGs against the LoIs due to it.
