Speaker rejects Kadam's privilege notice against CM

Nagpur, Dec 1 (UNI) Maharashtra Legislative Assembly Speaker Babasaheb Kupekar today rejected a notice of breach of privilege from Leader of the Opposition Ramdas Kadam against Chief Minister Vilasrao Deshmukh over the resolution scrapping the provisions of the Urban Land Ceiling (ULC) Act in the state.

Giving his ruling on the notice, Mr Kupekar said after examining Mr Kadam's notice and Mr Deshmukh's clarification on the same, he had reached the conclusion that making a commitment to the Centre about the scrapping of the Act without moving a resolution in the Legislative Assembly did not tantamount to a breach of privilege.

The government had followed the proper procedure, of making a decision first and then moving the relevant resolution in the regard, Mr Kupekar said. One was an administrative decision and the other the constitutional authority of the Legislature, and therefore, there was no question of a breach, he said. ''I am, therefore, denying permission to the notice,'' the Speaker said.

Mr Kadam had given the notice on Wednesday last saying the Chief Minister had committed a breach of privilege by committing to the Centre that the provisions of the ULC Act would be repealed in the state without consulting the Legislative Assembly first. ''The Chief Minister should have taken the House into confidence before making such a commitment,'' Mr Kadam had said. Mr Kupekar had at the time reserved his ruling on the notice.
