Jaya moves HC seeking stay over trial in IT returns case

Chennai, Nov 28 (UNI) AIADMK General Secretary J Jayalalithaa has moved the Madras High Court, seeking a direction to stay the trial procedure before the Economic Offences Wing (EOW) court in connection with the Income Tax returns case against her.

The petition is likely to come up for hearing tomorrow before Justice K Mohanram.

In the petition, Ms Jayalalithaa, submitted the EOW-I has commenced the trial, before passing orders on the discharge petition filed by her, and has sought a direction to restrain the court from going ahead with the trial procedure.

The case against Ms Jayalalaithaa was filed by the EOW of the Income Tax Department for not filing the Income Tax and Wealth Tax returns, for the assessment year 1993-94 and 1994-95.

In the year 2001, Ms Jayalalithaa had obtained a stay in the case, but the interim stay was subsequently vacated by the court, on a petition by the IT Department.

After the vacation of the stay order, she had filed a discharge petition. After hearing the arguments, EOW-I Judge R Premkumar, without passing orders, commenced trial.
