HC goes to renal patient's aid: directs relaxation of rules

Chennai, Nov 28 (UNI) The Madras High court today directed the medical authorities to relax certain rules to enable a woman patient to undergo kidney transplantation.

Mr Justice P Jyothmani passed the interim order on admitting a petition filed by Ms A Bhavani, a city resident, who submitted that she was suffering from chronic renal failure, but could not go for transplantation in view of certain rules.

She said she was entirely dependent on haemodialysis and she should undergo renal transplantation surgery. Considering her pathetic condition, her cousin, Ms Devi came forward to donate one of her kidneys, but the transplantation of Human Organs Act, 1994, says that only a blood relative could donate kidney.

In his direction judge said the Chairman of Authorization committee and Director of Medical Education should take out the petitioner's application for authorization for renal transplantation surgery and pass appropriate orders without insisting on compliance as contemplated in the order of the Hospital authorities or certificate or undertaking.
