Panaji, Nov 23 (UNI) The Bombay High Court IN Goa comprising Justices F I Rebello and N A Britto today directed two industries at the Cuncolim Industrial Estate to close their operations immediately.
Hearing the Public Interest Litigation(PIL) filed by Mr Oscar Martins regarding the polluting industries -- Sunrise Zinc Ltd and Nicomet Ltd -- the Court further directed the Goa State Pollution Control Board to immediately seal the two factories with the assistance of the South Goa Collector.
The Court also directed the Board to ensure that the hazardous waste generated by these two industries dumped at the Cuncolim Industrial Estate was properly secured to avoid further health hazard to the locality.
Taking a serious note of the hazardous waste being dumped in violation of the law, the Court expressed concern that the companies were operating without a secured landfill site as required by law.
Earlier Adv. Aires Rodrigues representing the petitioner made a strong plea that the companies be directed to shut down till they fulfilled all the requirements as per law.
Adv Rodrigues brought to the court's attention that the two polluting companies in rank violation of law were for the last ten years jointly generating around 20 tonnes of hazardous waste without having a secured hazardous waste disposal site as required by law.
He had further submitted that the authorities had given a complete go by to the provisions of the various laws and had failed in their duty to abate the environment pollution and health hazards being caused by the two polluting units at the Cuncolim Industrial Estate.
Adv Joaquim Godinho represented the Goa State Pollution Board while the polluting Companies were represented by Adv Vijay Nadkarni and Adv Mahesh Sonak.
