Allahabad, Oct 1 (UNI) The Allahabad High Court has stayed a government order issued on September 7, 2007, whereby, Uttar Pradesh government had amended its earlier scheme and deleted block pramukhs from operating the National Rural Employment Guarantee Programme (NREGP) fund, which was operated by the joint signatures of block pramukhs and block development officers.
By the impugned government order, the power to operate NREGP fund was given to the BDO and ADO of a block.
Staying the operation of the government order until further orders, the bench comprising Justices V M Sahai and Rakesh Sharma noted ''prima facie, the scheme framed by the UP government, which had been approved by Legislature and notified, could not be amended by government by executive instructions. Therefore, the petitioners are entitled for interim relief.'' The bench passed the order on a petition filed by Mr Gyanendra Singh, block pramukh, Halia Chetra Panchayat, Mirzapur, and 11 others.
The court directed the state govenment to file a counter affidavit in this case within a month, while two weeks time has been given to the petitioners to file a rejoinder affidavit in this case.
The court will hear this case after the expiry of this period.
