HC calls for record and proceedings of 7/11 trial

Mumbai, Sep 28 (UNI) The Bombay High Court today called for the records and proceedings from the special Maharashtra Control of Organised Crime court related to the 7/11 suburban train blasts.

Acting on an appeal filed by Aasif Khan Bashir Khan, one of the 13 accused being tried in the 7/11 blasts case, a division bench comprising Justices R M S Khandeparkar and V K Tahilramani today called for record and proceedings in the case.

Aasif Khan has challenged application of MCOCA to the case saying that one of the essential conditions of having more than one chargesheet been filed against any one member of the alleged organised crime syndicate, was not fulfilled in the case, in preceding ten years period.

The Anti-Terrorist Squad had applied provisions of stringent MCOCA on the basis that two chargesheets were filed against Aasif Khan in two different cases in Jalgaon district. But, Aasif Khan has contended in his appeal that second chargesheet was filed against him much after sanction of MCOCA was granted in the 7/11 case.

His counsel Mubin Solkar pointed out to the court that the second chargesheet was filed against Aasif Khan on March 22, 2007 whereas sanction to apply MCOCA to the case was granted by competent authority much before on November 2006. The matter will now come up for further hearing on October 5.
