HC stays construction of Hotel in Pune

Mumbai, Sep 27 (UNI) The Bombay High Court today stayed construction of a Hotel, coming up as part of infrastructure required for Commonwealth Youth Games, scheduled to take place in Pune in October 2008.

Unity constructions had taken up the construction of the Hotel, on 'built own and operate basis' after the state government allotted a tender to it. The Hotel, being constructed in Balewadi area of Pune city, is to be used for stay of participants and office bearers, accompanying the participants of the Games.

One Sanjay Balgude had moved the high court against the construction, saying it was illegal, as the site of was shown as semi-public zone in the approved development-plan of the Pune Municipal Corporation.

He has contended that the state government has granted permission to construct a commercial hotel without changing user of the area.

A division bench comprising Justice J N Patel and Justice Amjad Sayyad today directed the Pune Municipal Corporation and the state government to file, within two weeks, reply affidavits on the petition and stayed construction of the hotel till then.
