Par attack case: SC issues notice to Delhi govt
New Delhi, Aug 27: The Supreme Court today issued notices to the Delhi Government and the CBI on a petition filed by Shaukat Hussain Guru, who has been sentenced to 10-year imprisonment in the Parliament attack case.
A bench comprising Justices P P Naolekar and R V Raveendran issued the notices on the petition in which Shaukat challenged his conviction, saying he was not heard for the offence for which he has been punished.
Appearing for the petitioner, senior counsel Shanti Bhushan contended before the court that charges under section 123 of IPC were never framed against his client and he was never given an opportunity to defend himself during the trial.
Mr Bhushan also contended that Shaukat's conviction and sentence were completely illegal and a person cannot be sent to jail without being given an adequate opportunity to defend himself.
Notably, the Supreme Court had earlier dismissed an appeal, a review petition and a curative petition filed by Shaukat.
