Guj: Policeman named in fake encounter surrenders

Ahmedabad, May 22: Fearing persecution from the investigating agency, policeman Nathubha Jadeja, accused in the 2005 fake encounter of Soharabuddin Sheikh and his wife Kauser Bi, surrendered before the Chief Metropolitan Magistrate Court here today.

Jadeja, who was the driver of Gujarat Anti-Terrorist Squad (ATS) at the time of alleged fake encounter on November 26, 2005, pleaded before Metropolitan Magistrate H A Shah that he feared persecution at the hands of investigating officers who, he alleged, may take out a forced statement under 164 CrPc (Criminal Procedure Code).

Therefore, he chose to surrender before the court.

In his statement, Mr Jadeja said ''I have strong fear that I would be forced to make statment, which I do not intend to.'' ''I also retract everything that I said during the interrogation by Rajneesh Rai on April 25,'' Mr Jadeja said while referring to his questioning by senior police officer Mr Rai on April 26.

According to Mr Jadeja's advocate Ketan Shah, the court did not arrest Mr Jadeja, as he had surrendered.

''The court let go Mr Jadeja. The court will decide whether to make arrest or not on May 24,'' Mr Shah told sources.
